You just completed negotiations for a five-year term contract where the end-users have been adversarial and difficult to work with. Just as you are preparing to make an award, the department head tells you that in about 2 years they plan to double the amount of work (and contract value). What is your response?

AP Response:

The agency operated in a culture of self-preservation, where staff often deflected responsibility to avoid conflict. The agency head was particularly difficult to work with, which complicated the process. Upon learning that the agency intended to double the contract’s scope within two years, we consulted the Division Director. He agreed that this constituted a material scope change.

The Division Director contacted the agency head to inform her that we would be reissuing the RFP. He then instructed us to complete the new procurement and make an award within 30 days—which we did.
