Plunder Scenario 19
You issued a solicitation for dining services for a K-12 school for the Deaf and Blind. A USDA rep insists the solicitation be amended to include boiler plate contract clauses provided by their consortium group. You find the same items are already in your boiler plate and you prefer to keep the ones you can defend in a protest or dispute. How do you resolve this?
AP Response:
Request a meeting with the USDA representative to discuss the required contract clauses. Prepare a spreadsheet that clearly identifies which of their requested clauses are duplicative of those already included in your boilerplate, and explain how your existing language meets the intent and requirements of the FAR (Federal Acquisition Regulation).
