Your IT Director is seeking your approval to sign an MOU for consulting services. You don't like the terms and conditions and point out that some are contrary to procurement law. He answers that the new general counsel already approved it. How do you respond?

AP Response:

We provided both the IT Director and General Counsel with the relevant language from the code. When they pushed back, we made it clear that I would not continue debating the issue and that they were free to proceed as they saw fit. We had already documented and shared my concerns in writing, and forwarded that correspondence to the Chief Procurement Officer (CPO), who confirmed that the interpretation was correct. As a result, the language was ultimately revised.
